Licence agreement

What you may and may not do with the software, how the licence key works, and where our responsibility ends.

1. What this agreement is

This is the licence agreement between you and Zhongcheng Huang, an individual (sole proprietor) trading as "Hamm Software", for the Hamm Software desktop applications - the Dialogs edition and the Vocabulary edition of each product - together with their data and audio recordings ("the software"). By installing, copying or using the software you accept it. If you do not accept it, do not use the software, and ask us for a refund as described in the refund policy.

2. What the licence allows

  • You may install and use the software on the computers you own or control, for your own personal use.
  • You may make a reasonable number of backup copies, for example on a USB stick or an external drive.
  • You may keep using the version you licensed for as long as you like - the licence has no expiry date.
  • One licence key covers one language and both of its editions (Dialogs and Vocabulary).

3. What the licence does not allow

  • Selling, renting, sublicensing, lending or giving away the software or a licence key to anybody else.
  • Publishing a key on a website, a forum or a file-sharing service, or using keys obtained that way.
  • Copying the audio recordings, lesson data, help pages or artwork into another product or service, or redistributing them.
  • Removing or altering any copyright notice, product name or version information.
  • Reverse engineering, decompiling or disassembling the software, except where the law of your country expressly allows it and only to the extent that it does.

4. The free trial

The software can be used free of charge for seven days from the first launch. The trial is recorded per Windows user account on your computer. When it ends, the software asks for a licence key and, if you decline, it closes; nothing on your computer is deleted and the trial is not extended by reinstalling.

5. Licence keys and activation

Keys are verified inside the app, without contacting us. You are responsible for keeping your key confidential. If you lose it, write to us from the address you ordered with and we will look up the order and re-issue it. Keys are not tied to a machine, so you may activate your own key on a new computer yourself.

6. Updates and support

Updates within the 1.x series of the product are free to licence holders. Support is provided by e-mail, in good faith and with reasonable effort, while you hold a valid licence.

7. Ownership

The software is licensed, not sold. We and our licensors keep all rights, title and interest in the software, its audio recordings, its lesson data, its name and its artwork.

8. Warranty and liability

The software is provided as it is. We do not warrant that it will be free of errors or that it will run on every possible combination of hardware and software; the published system requirements are the reference, and the free trial exists so you can check the software on your own PC before paying. To the extent permitted by law, our total liability arising from the software is limited to the amount you paid for the licence. Nothing in this agreement excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence.

9. When the licence ends

The licence ends if you breach this agreement - for example by publishing a key or redistributing the recordings. If it ends, please uninstall the software and delete the key. You may of course also simply stop using the software at any time.

10. Consumer rights, law and contact

If you are a consumer, you keep the mandatory rights of the consumer law of your country of residence; nothing here removes them. This agreement is governed by the laws of the People's Republic of China. Questions about licensing: myhama@hotmail.com.
